1. Wer mit wem einen Vertrag schließt
1.1 Anbieter von funditio.ai ist Mag. Dr. Gerold Weiß Unternehmensberatung, Einzelunternehmen, Verdistraße 3, 4600 Schleißheim, Österreich, UID ATU63887422, E-Mail hallo@funditio.ai („wir“).
1.2 Diese Nutzungsbedingungen regeln die Nutzung von funditio.ai durch natürliche Personen („du“). Sie gelten für den kostenlosen Probelauf und für die Nutzung mit einem Zugangscode, gleich auf welchem Weg du den Code erhalten hast.
1.3 Du kannst Verbraucher oder Unternehmer im Sinne des Konsumentenschutzgesetzes (KSchG) sein. Wer ein Unternehmen erst gründen will, gilt dabei in der Regel noch als Verbraucher (§ 1 Abs 3 KSchG). Bestimmungen, die nur für Verbraucher oder nur für Unternehmer gelten, sind ausdrücklich als solche bezeichnet.
1.4 Den Founder Pass kaufst du bei unserem Vertriebspartner Digistore24 GmbH, St. Ingbert, Deutschland. Digistore24 verkauft ihn im eigenen Namen und ist für den Kauf dein Vertragspartner. Preis, Zahlung, Rechnung und dein Rücktrittsrecht richten sich nach den Bedingungen von Digistore24, die dir beim Kauf angezeigt werden. Für die Nutzung von funditio.ai mit dem gekauften Code gelten diese Nutzungsbedingungen.
1.5 Hast du deinen Code von einer Hochschule, einem Inkubator, einem Gründerzentrum oder einer anderen Einrichtung erhalten („Institution“), ist diese Institution nicht Partei dieser Nutzungsbedingungen. Was wir mit ihr vereinbaren, regelt ein eigener Vertrag.
2. Was funditio ist
2.1 funditio.ai ist ein webbasiertes Denkwerkzeug für Gründerinnen und Gründer. In sechs aufeinander aufbauenden Stationen (derzeit Verstehen, Entdecken, Entscheiden, Umsetzen, Überzeugen und Gründen) führen dich Fragen durch dein Gründungsvorhaben. Deine Ergebnisse, etwa Geschäftsmodell, Businessplan und Pitchdeck, kannst du als Dokument herunterladen.
2.2 Einzelne Funktionen arbeiten mit künstlicher Intelligenz: der KI Funke, der dir Rückfragen und neue Blickwinkel gibt, die Hilfe Lily, die Fragen zur Bedienung beantwortet, sowie Funktionen, die aus deinen Stichworten ganze Sätze oder Folien formulieren. Diese Funktionen sind als KI gekennzeichnet. Lily ist eine KI und kein Mensch.
2.3 Die Inhalte der Station Gründen beziehen sich auf die Rechtslage in Österreich.
3. Wie du zu funditio kommst
3.1 Probelauf. Ohne Code und ohne Anmeldung kannst du Station 01 und den Einstieg in Station 02 kostenlos nutzen. Deine Eingaben bleiben dabei in deinem Browser. Löst du später einen Code im selben Browser ein, nimmst du sie in die Reise mit.
3.2 Founder Pass. Du kaufst den Founder Pass über Digistore24 (Punkt 1.4) und erhältst danach einen persönlichen Code. Der Code kann ohne Frist eingelöst werden. Ab der ersten Anmeldung gilt er sechs Monate.
3.3 Code von einer Institution. Die Institution gibt dir einen Code und nennt dir das Datum, bis zu dem er eingelöst werden kann. Ab der ersten Anmeldung gilt er sechs Monate, auch wenn du ihn erst kurz vor diesem Datum einlöst.
3.4 Andere Codes. Codes für Kurse, Veranstaltungen oder Tests gelten bis zu dem Datum, das dir bei der Ausgabe genannt wird.
3.5 Wann dein Code abläuft, sagen wir dir auf Anfrage.
4. Zustimmung und Änderungen
4.1 Diese Nutzungsbedingungen gelten, wenn du ihnen beim ersten Einlösen deines Codes zustimmst. Ohne Zustimmung ist keine Nutzung mit Code möglich. Für den Probelauf gelten sie mit dem Start des Probelaufs. Andere Geschäftsbedingungen gelten nur, wenn wir ihnen vorher ausdrücklich zugestimmt haben.
4.2 Für dich gilt die Fassung, der du beim ersten Einlösen zugestimmt hast, und zwar für die gesamte Laufzeit deines Codes. Ändern wir die Nutzungsbedingungen in dieser Zeit, gilt die neue Fassung für dich nur, wenn du ihr ausdrücklich zustimmst.
4.3 Die aktuelle Fassung ist unter funditio.ai/nutzungsbedingungen.html abrufbar und kann gespeichert und ausgedruckt werden.
5. Dein Zugangscode
5.1 Ein Konto, eine E-Mail-Adresse oder dein Name sind für die Nutzung nicht nötig. Der Code ist dein Schlüssel.
5.2 Jeder Code ist für genau eine Person bestimmt. Wer deinen Code kennt, kann deine Inhalte sehen und verändern. Halte ihn deshalb geheim und gib ihn nicht weiter.
5.3 Hast du den Verdacht, dass jemand anderer deinen Code kennt, melde dich bitte sofort unter hallo@funditio.ai. Wir dürfen einen Code zum Schutz vor Missbrauch sperren und stellen dir dann einen Ersatzcode für die restliche Laufzeit aus. Deinen bisherigen Stand übertragen wir auf Wunsch.
5.4 funditio.ai steht Personen ab dem vollendeten 16. Lebensjahr offen.
5.5 Wird ein Founder Pass nach einem Rücktritt oder einer Rückbuchung rückabgewickelt, dürfen wir den zugehörigen Code sperren.
6. Deine Inhalte
6.1 Alles, was du eingibst, und die Ergebnisse, die daraus entstehen, gehören dir. Wir erwerben daran keine Rechte.
6.2 Du erlaubst uns, deine Inhalte zu speichern, zu verarbeiten und an unseren KI-Dienstleister zu übermitteln, soweit das für den Betrieb von funditio.ai nötig ist. Wir verwenden sie für keinen anderen Zweck, insbesondere nicht für Werbung und nicht zum Trainieren von KI. Wir sehen sie uns nicht an, außer du bittest uns darum, etwa bei einem technischen Problem, oder das Gesetz verlangt es.
6.3 Die Institution, von der du deinen Code hast, erhält von uns keine Einsicht in deine Inhalte. Was du selbst mit ihr teilst, entscheidest du.
6.4 Du bist für deine Inhalte verantwortlich. Gib bitte nichts ein, was du nicht verwenden darfst, etwa Geschäftsgeheimnisse anderer oder fremde geschützte Texte, und keine personenbezogenen Daten Dritter, die für deine Arbeit nicht nötig sind. Besondere Kategorien personenbezogener Daten, etwa Gesundheitsdaten, gehören nicht hinein.
6.5 Antworten der KI entstehen automatisch. Wir können nicht zusichern, dass sie richtig, vollständig oder frei von Rechten Dritter sind. Prüfe sie, bevor du sie weiterverwendest.
7. Unsere Rechte an funditio
7.1 Die funditio-Methode, die Software, die Stationen, Texte, Fragen, Vorlagen, Grafiken, der Wegbegleiter und die Marke funditio stammen von uns und sind geschützt.
7.2 Wir räumen dir für die Laufzeit deines Codes ein einfaches, nicht übertragbares Recht ein, funditio.ai für dein eigenes Gründungsvorhaben zu nutzen. Deine heruntergeladenen Ergebnisdokumente darfst du ohne zeitliche Grenze frei verwenden, etwa gegenüber Banken, Förderstellen, Investoren oder Partnern, auch soweit darin Fragen oder Strukturen von funditio enthalten sind.
7.3 Nicht erlaubt ist es, funditio.ai oder Teile davon zu vervielfältigen, nachzubauen, mit automatisierten Mitteln auszulesen, zu dekompilieren, die KI-Funktionen für andere Zwecke als dein Vorhaben zu verwenden oder funditio anderen zugänglich zu machen, soweit das Gesetz es nicht ausdrücklich erlaubt.
8. Kosten
8.1 Der Probelauf ist kostenlos.
8.2 Der Founder Pass kostet den Preis, der beim Kauf bei Digistore24 angegeben ist, derzeit einmalig 49 Euro einschließlich Umsatzsteuer. Er ist kein Abo und verlängert sich nicht. Es fallen keine weiteren Kosten an.
8.3 Hast du deinen Code von einer Institution, ist die Nutzung für dich unentgeltlich, außer die Institution vereinbart mit dir etwas anderes.
8.4 Kosten deines Internetanbieters, etwa für mobiles Datenvolumen, trägst du selbst.
9. Verfügbarkeit und Weiterentwicklung
9.1 Wir bemühen uns, funditio.ai ständig verfügbar zu halten, können das aber nicht zusichern. Die Erreichbarkeit hängt auch von Netzen und Diensten ab, auf die wir keinen Einfluss haben, etwa dem KI-Dienstleister. Für Wartung, Updates und die Sicherheit dürfen wir den Zugang vorübergehend einschränken.
9.2 Um Missbrauch zu verhindern, dürfen wir die Zahl der KI-Anfragen je Code und Tag in einem Maß begrenzen, das eine gewöhnliche Nutzung nicht behindert.
9.3 Wir entwickeln funditio.ai weiter und dürfen es dabei verändern, soweit dir die Änderung zumutbar ist, insbesondere weil sie geringfügig und sachlich gerechtfertigt ist und den Kern der Leistung nicht verschlechtert. Stellen wir funditio.ai oder eine Station ganz ein, kündigen wir das rechtzeitig vorher auf der Website an, damit du deine Ergebnisse herunterladen kannst.
10. Ende der Nutzung und Löschung
10.1 Der Nutzungsvertrag beginnt mit deiner Zustimmung und endet automatisch, wenn dein Code abläuft.
10.2 Du kannst die Nutzung jederzeit beenden. Auf deinen Wunsch per E-Mail löschen wir deine Inhalte. Gib dazu deinen Code an, sonst können wir sie nicht finden.
10.3 Nach Ablauf kannst du dich mit dem Code nicht mehr anmelden. Lade deine Ergebnisse deshalb rechtzeitig herunter. Die unter dem Code auf unserem Server gespeicherten Inhalte löschen wir in regelmäßigen Abständen, spätestens zwölf Monate nach Ablauf des Codes. Bis dahin übertragen wir sie auf Wunsch auf einen neuen Code. Die Kopie in deinem Browser bleibt dort, bis du sie selbst entfernst.
10.4 Wir dürfen deinen Code aus wichtigem Grund sofort sperren und den Vertrag damit beenden, insbesondere wenn du den Code weitergibst, funditio.ai angreifst oder automatisiert ausliest oder bei der Nutzung gegen Rechte Dritter oder gegen Gesetze verstößt. Punkt 10.3 gilt entsprechend.
11. Keine Beratung
11.1 funditio.ai ist ein Denkwerkzeug. Die Inhalte, auch die der Station Gründen zu Rechtsform, Gewerbe, Sozialversicherung, Steuern und Förderungen, sind allgemeine Orientierung für Österreich mit dem jeweils angegebenen Stand. Sie sind keine Rechts-, Steuer-, Förder- oder Unternehmensberatung und ersetzen keine Prüfung deines Einzelfalls. Gesetze, Beträge und Fristen können sich ändern.
11.2 Antworten der KI sind Impulse. Sie können unvollständig, veraltet oder falsch sein.
11.3 Die Entscheidungen über dein Vorhaben und ihre Folgen liegen bei dir. Einen bestimmten geschäftlichen Erfolg schulden wir nicht.
12. Gewährleistung und Haftung
12.1 Hast du einen Founder Pass gekauft, richten sich die Ansprüche aus dem Kauf, insbesondere die Gewährleistung, nach den gesetzlichen Bestimmungen und den Bedingungen von Digistore24. Hast du deinen Code unentgeltlich erhalten, bestehen Gewährleistungsansprüche nur, soweit das Gesetz sie auch für unentgeltliche Leistungen vorsieht.
12.2 Wir haften unbeschränkt für Schäden, die wir oder unsere Gehilfen vorsätzlich oder grob fahrlässig verursachen, für Personenschäden und nach dem Produkthaftungsgesetz.
12.3 Für Verbraucher: Für leicht fahrlässig verursachte Sach- und Vermögensschäden haften wir nicht.
12.4 Für Unternehmer: Die Haftung für leichte Fahrlässigkeit, entgangenen Gewinn, Folgeschäden, Datenverlust und reine Vermögensschäden ist ausgeschlossen, soweit das gesetzlich zulässig ist. Die Haftung ist der Höhe nach mit dem Preis des Founder Pass begrenzt.
12.5 Für den Verlust von Inhalten haften wir nicht, soweit du ihn durch das rechtzeitige Herunterladen deiner Ergebnisse hättest vermeiden können.
13. Datenschutz
13.1 Wir verarbeiten nur die Daten, die für den Betrieb von funditio.ai nötig sind. Damit du an jedem Gerät weiterarbeiten kannst, speichern wir deine Eingaben auf unserem Server unter einer Kennung, die aus deinem Code abgeleitet ist, dazu eine Kopie in deinem Browser. Deine Eingaben im Probelauf bleiben nur in deinem Browser. Was du an eine KI-Funktion schickst, geht an unseren KI-Dienstleister.
13.2 Alles Weitere, auch zu deinen Rechten, steht in der Datenschutzerklärung unter funditio.ai/datenschutz.html.
14. Recht, Gericht, Sprache
14.1 Es gilt österreichisches Recht unter Ausschluss der Verweisungsnormen und des UN-Kaufrechts. Für Verbraucher: Die zwingenden, für dich günstigeren Bestimmungen des Rechts deines gewöhnlichen Aufenthalts bleiben unberührt (Art 6 Abs 2 Rom I-VO).
14.2 Für Unternehmer: Gerichtsstand ist das sachlich zuständige Gericht in Wels. Für Verbraucher: Es gilt § 14 KSchG. Du kannst nur an deinem Wohnsitz, deinem gewöhnlichen Aufenthalt oder deinem Beschäftigungsort geklagt werden.
14.3 Wir sind weder verpflichtet noch bereit, an Verfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
14.4 Vertragssprache ist Deutsch. Die englische Fassung dient der Orientierung, maßgeblich ist die deutsche.
15. Mitteilungen und Schlussbestimmungen
15.1 Mitteilungen an uns schickst du an hallo@funditio.ai. Da wir keine Kontaktdaten von dir haben, informieren wir dich über funditio.ai selbst, etwa beim Anmelden.
15.2 Erklärungen per E-Mail genügen.
15.3 Für Unternehmer: Ist eine Bestimmung unwirksam, bleibt der Rest gültig. An die Stelle der unwirksamen Bestimmung tritt eine, die ihrem Zweck am nächsten kommt.

1. Who enters into a contract with whom
1.1 The provider of funditio.ai is Mag. Dr. Gerold Weiß Unternehmensberatung, sole proprietorship, Verdistraße 3, 4600 Schleißheim, Austria, VAT ID ATU63887422, email hallo@funditio.ai (“we”).
1.2 These terms of use govern the use of funditio.ai by natural persons (“you”). They apply to the free trial run and to use with an access code, regardless of how you received the code.
1.3 You may be a consumer or a business within the meaning of the Consumer Protection Act (KSchG). A person who is only planning to set up a business is generally still regarded as a consumer (section 1(3) KSchG). Provisions that apply only to consumers or only to businesses are expressly marked as such.
1.4 You buy the Founder Pass from our sales partner Digistore24 GmbH, St. Ingbert, Germany. Digistore24 sells it in its own name and is your contractual partner for the purchase. Price, payment, invoice and your right of withdrawal are governed by the terms of Digistore24, which are shown to you at the time of purchase. These terms of use apply to the use of funditio.ai with the purchased code.
1.5 If you received your code from a university, an incubator, a startup centre or another organisation (“institution”), that institution is not a party to these terms of use. What we agree with it is governed by a separate contract.
2. What funditio is
2.1 funditio.ai is a web-based thinking tool for founders. In six successive stations (currently Understand, Discover, Decide, Build, Convince and Found), questions guide you through your start-up project. You can download your results, such as business model, business plan and pitch deck, as a document.
2.2 Some functions work with artificial intelligence: the Spark, which gives you follow-up questions and new perspectives, the help assistant Lily, who answers questions about how to use the tool, and functions that turn your keywords into complete sentences or slides. These functions are labelled as AI. Lily is an AI and not a human being.
2.3 The content of the Found station relates to the legal situation in Austria.
3. How you get access to funditio
3.1 Trial run. Without a code and without logging in, you can use Station 01 and the opening of Station 02 free of charge. Your entries stay in your browser. If you later redeem a code in the same browser, you take them with you on the journey.
3.2 Founder Pass. You buy the Founder Pass through Digistore24 (clause 1.4) and then receive a personal code. The code can be redeemed without any time limit. From the first login it is valid for six months.
3.3 Code from an institution. The institution gives you a code and tells you the date by which it can be redeemed. From the first login it is valid for six months, even if you redeem it only shortly before that date.
3.4 Other codes. Codes for courses, events or tests are valid until the date you are told when they are issued.
3.5 We will tell you on request when your code expires.
4. Consent and changes
4.1 These terms of use apply once you accept them when you first redeem your code. Use with a code is not possible without your consent. For the trial run, they apply from the start of the trial run. Other terms and conditions apply only if we have expressly agreed to them in advance.
4.2 The version that applies to you is the one you accepted when you first redeemed your code, and it applies for the entire term of your code. If we change the terms of use during this period, the new version applies to you only if you expressly accept it.
4.3 The current version is available at funditio.ai/nutzungsbedingungen.html and can be saved and printed.
5. Your access code
5.1 You do not need an account, an email address or your name to use the service. The code is your key.
5.2 Each code is intended for exactly one person. Anyone who knows your code can see and change your content. So keep it secret and do not pass it on.
5.3 If you suspect that someone else knows your code, please contact us immediately at hallo@funditio.ai. We may block a code to protect against misuse and will then issue you a replacement code for the remaining term. On request, we will transfer your progress so far.
5.4 funditio.ai is open to persons aged 16 and over.
5.5 If a Founder Pass is reversed following a withdrawal or a chargeback, we may block the associated code.
6. Your content
6.1 Everything you enter and the results that come from it belong to you. We acquire no rights to them.
6.2 You allow us to store and process your content and to transmit it to our AI service provider, insofar as this is necessary for operating funditio.ai. We do not use it for any other purpose, in particular not for advertising and not for training AI. We do not look at it unless you ask us to, for example in the case of a technical problem, or the law requires it.
6.3 The institution from which you received your code is given no access to your content by us. What you share with it yourself is up to you.
6.4 You are responsible for your content. Please do not enter anything you are not allowed to use, such as other people’s trade secrets or protected texts belonging to others, and no personal data of third parties that is not necessary for your work. Special categories of personal data, such as health data, do not belong in it.
6.5 AI responses are generated automatically. We cannot guarantee that they are correct, complete or free from third-party rights. Check them before you use them further.
7. Our rights in funditio
7.1 The funditio method, the software, the stations, texts, questions, templates, graphics, the companion book and the funditio brand originate from us and are protected.
7.2 For the term of your code, we grant you a simple, non-transferable right to use funditio.ai for your own start-up project. You may use your downloaded result documents freely and without time limit, for example with banks, funding bodies, investors or partners, even where they contain questions or structures from funditio.
7.3 You may not copy, replicate, extract by automated means or decompile funditio.ai or parts of it, use the AI functions for purposes other than your project, or make funditio available to others, unless the law expressly permits it.
8. Costs
8.1 The trial run is free of charge.
8.2 The Founder Pass costs the price stated at the time of purchase at Digistore24, currently a one-off 49 euros including VAT. It is not a subscription and does not renew. There are no further costs.
8.3 If you received your code from an institution, use is free of charge for you, unless the institution agrees otherwise with you.
8.4 You bear the costs of your internet provider yourself, for example for mobile data.
9. Availability and further development
9.1 We make every effort to keep funditio.ai available at all times, but we cannot guarantee this. Availability also depends on networks and services over which we have no influence, such as the AI service provider. We may temporarily restrict access for maintenance, updates and security.
9.2 To prevent misuse, we may limit the number of AI requests per code and day to a level that does not hinder ordinary use.
9.3 We continue to develop funditio.ai and may change it in the process, insofar as the change is reasonable for you, in particular because it is minor and objectively justified and does not impair the core of the service. If we discontinue funditio.ai or a station entirely, we will announce this on the website in good time so that you can download your results.
10. End of use and deletion
10.1 The contract of use begins with your consent and ends automatically when your code expires.
10.2 You can stop using the service at any time. At your request by email, we will delete your content. Please state your code, otherwise we cannot find it.
10.3 After expiry, you can no longer log in with the code. So download your results in good time. We delete the content stored under the code on our server at regular intervals, at the latest twelve months after the code expires. Until then, we will transfer it to a new code on request. The copy in your browser stays there until you remove it yourself.
10.4 We may block your code immediately for good cause and thereby terminate the contract, in particular if you pass the code on, attack funditio.ai or extract data from it by automated means, or infringe third-party rights or laws in your use. Clause 10.3 applies accordingly.
11. No advice
11.1 funditio.ai is a thinking tool. The content, including that of the Found station on legal form, trade licence, social insurance, taxes and funding, is general guidance for Austria as of the date stated in each case. It is not legal, tax, funding or business advice and does not replace an examination of your individual case. Laws, amounts and deadlines may change.
11.2 AI responses are prompts for thought. They may be incomplete, out of date or wrong.
11.3 The decisions about your project and their consequences are yours. We do not owe any particular business success.
12. Warranty and liability
12.1 If you bought a Founder Pass, claims arising from the purchase, in particular warranty claims, are governed by the statutory provisions and the terms of Digistore24. If you received your code free of charge, warranty claims exist only insofar as the law provides for them for free services as well.
12.2 We are liable without limitation for damage caused intentionally or through gross negligence by us or our agents, for personal injury and under the Product Liability Act.
12.3 For consumers: We are not liable for damage to property or financial loss caused through slight negligence.
12.4 For businesses: Liability for slight negligence, lost profit, consequential damage, loss of data and pure financial loss is excluded to the extent permitted by law. Liability is limited in amount to the price of the Founder Pass.
12.5 We are not liable for the loss of content insofar as you could have avoided it by downloading your results in good time.
13. Data protection
13.1 We process only the data necessary for operating funditio.ai. So that you can continue working on any device, we store your entries on our server under an identifier derived from your code, together with a copy in your browser. Your entries in the trial run stay only in your browser. Whatever you send to an AI function goes to our AI service provider.
13.2 Everything else, including information on your rights, can be found in the privacy policy at funditio.ai/datenschutz.html.
14. Law, court, language
14.1 Austrian law applies, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers: The mandatory provisions of the law of your habitual residence that are more favourable to you remain unaffected (Art 6(2) Rome I Regulation).
14.2 For businesses: The place of jurisdiction is the competent court in Wels, Austria. For consumers: Section 14 KSchG applies. You can be sued only at your place of residence, your habitual residence or your place of employment.
14.3 We are neither obliged nor willing to take part in proceedings before a consumer dispute resolution body.
14.4 The language of the contract is German. The English version is provided for guidance, the German version is authoritative.
15. Notices and final provisions
15.1 Send notices to us at hallo@funditio.ai. As we have no contact details for you, we inform you through funditio.ai itself, for example when you log in.
15.2 Declarations by email are sufficient.
15.3 For businesses: If a provision is invalid, the rest remains valid. The invalid provision is replaced by one that comes closest to its purpose.
